By accessing the Website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website or purchase our products.
Our products
AOHBL sells digital educational products – a preschool homeschool curriculum for children
aged approximately 3 to 6, including complete courses, individual courses, workbooks,
phonics, reading and music materials, and related downloadable resources (the “Products”).
Unless expressly stated otherwise on a specific product page, all Products are supplied as
digital downloads. No physical goods are shipped.
We make every effort to describe and display our Products accurately. However, sample
images, previews and descriptions are for illustration, and minor variations may occur.
Pricing
All prices are displayed in South African Rand (ZAR).
We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you complete checkout. Promotional prices apply only for the stated period.
Orders and acceptance
When you place an order, you make an offer to purchase the Product at the displayed price. A contract is formed only once we have confirmed your order and received full payment. We reserve the right to decline or cancel any order – for example, where a pricing error has occurred or payment cannot be verified – in which case any amount paid will be refunded.
Payment
Payments are processed securely through PayFast (Pty) Ltd, a registered South African payment gateway, and through PayPal. We accept the payment methods made available by these providers at checkout, which may include credit and cheque cards, Instant EFT, PayPal balance or linked accounts, and other supported options.
All card and banking details are entered directly into the secure environment of PayFast or PayPal, as applicable. AOHBL does not see, collect, or store your card or banking details. Payment processing is subject to the respective provider’s own terms and security standards.
You warrant that you are authorised to use the payment method you select and that there
are sufficient funds or credit to cover the transaction.
Delivery of digital products
Because our Products are digital:
- Upon successful payment, you will receive your download(s) or a download link, ordinarily by email.
- Delivery is normally immediate or within a short period after payment is confirmed. If you have not received your download within 24 hours, please contact us at info@aohbl.com.
- It is your responsibility to provide a correct email address and to ensure you can receive and open the file formats supplied (for example, PDF). Download links may be subject to a reasonable expiry period or download limit.
Cooling-off, returns and refunds
Nature of digital goods
Our Products are digital goods that are consumed immediately upon download. Once a Product has been downloaded or opened, it cannot be “returned” in any meaningful sense.
Cooling-off rights
The cooling-off right under section 44 of the Electronic Communications and Transactions Act, 2002 does not apply to digital Products once download has begun, in line with the exceptions provided in that Act. By starting the download, you acknowledge and agree that your right to cancel under that section falls away.
When we will provide a refund
Notwithstanding the above, we want you to be satisfied. We will provide a refund or replacement where:
- a Product is faulty, corrupted, or materially not as described; or
- you were charged in error or charged more than once; or
- you paid but did not receive your download and we are unable to resolve the issue.
Refund requests must be sent to info@aohbl.com within 7 days of purchase, with your order
number and a description of the problem. Approved refunds are made to the original
payment provider (PayFast or PayPal). - We do not provide refunds simply because a Product has been downloaded and the
customer has changed their mind, or because the customer’s device or software could not
open a correctly supplied file.
Cancellation policy
Because our Products are digital and delivered immediately:
- You may cancel an order at any time before the download has been made available or
the download has begun. If you have already paid, the full amount will be refunded. - We may also cancel an order before delivery — for example, where a pricing error has
occurred or payment cannot be verified — in which case any amount paid will be
refunded (see clause 4). - Once a download has begun or access has been provided, the sale is final and the
cancellation right under section 44 of the Electronic Communications and Transactions
Act, 2002 no longer applies (see clause 7.2). Refunds after this point are only available
in the circumstances set out in clause 7.3.
To cancel an order, contact us as soon as possible at info@aohbl.com with your order
number.
Licence to use the curriculum
When you purchase a Product, you receive a limited, non-exclusive, non-transferable licence
to use it as follows:
- for the personal, non-commercial educational use of children in your own home or,
where purchased by an educator, within the educator’s own classroom or teaching
practice; - to print copies reasonably required for that purpose.
You may not: - resell, redistribute, sub-licence, share, upload, or otherwise make the Products (in
whole or in part) available to any third party; - reproduce the Products for commercial gain;
- remove or alter any copyright, branding, or proprietary notices.
Intellectual property
All content on the Website and in the Products – including the curriculum, lesson plans,
worksheets, text, images, audio, video, logos, and design – is the intellectual property of
AOHBL and/or Dr Edwina Grossi and Richard Grossi, or is used under licence, and is
protected by South African and international copyright law. Nothing in these Terms transfers
ownership of any intellectual property to you. The licence in clause 9 is your only right of
use.
Acceptable use
You agree not to use the Website unlawfully, to attempt to gain unauthorised access to any
part of it, to introduce malicious code, or to interfere with its operation or security.
Limitation of liability
Our Products are educational resources provided in good faith. They are supplied “as is”,
and we do not warrant that any particular learning outcome will be achieved, as results
depend on many factors outside our control.
To the maximum extent permitted by law, AOHBL’s total liability arising from any Product or
your use of the Website is limited to the amount you paid for the Product in question. We are
not liable for any indirect or consequential loss. Nothing in these Terms limits any liability
that cannot lawfully be limited, including under the Consumer Protection Act, 2008.
Privacy
Your personal information is handled in accordance with our Privacy Policy and the
Protection of Personal Information Act, 2013 (POPIA). Please review it to understand how
we collect and use your information.
Links to third parties
The Website may contain links to third-party sites or services (such as PayFast, PayPal,
YouTube, or social media). We are not responsible for the content or practices of those third
parties, and their terms and policies apply to your use of them.
Changes to these Terms
We may update these Terms from time to time. The version published on the Website at the
time of your purchase governs that purchase. We encourage you to review this page
periodically.
Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be
subject to the jurisdiction of the South African courts. We encourage you to contact us first at
info@aohbl.com so we can try to resolve any concern directly.
